This talk will address the issue of writing medical reports for submission to the Court in Mental Capacity Act cases. A key question that a doctor writing a medical report will face is how much detail to include in a report and what issues need to be addressed as reports on mental capacity issues differ significantly from medical reports focusing on other issues. Also, some matters may be apparent to the doctor treating the patient but unless it is clearly described in detail in a medical report, the situation may not be quite so apparent when the application is submitted to the Court. Some of the common errors and pitfalls seen in medical reports and which may result in requests for further reports or clarifications will be highlighted. Also, the speaker will introduce the new online medical report system which the Court will be implementing in due course.
