Earlier this year, the Court of Appeal delivered a landmark decision on medical negligence in the Hii Chii Kok case, which concerned a surgical procedure later alleged to have been unnecessary. The decision retained a physician-centric test with regard to diagnosis and treatment, but laid down a new, patient-centric test with regard to advice. In this talk, the Chief Justice will discuss the content of this new test, explore how it relates to the professional guidelines promulgated by the SMC, and offer some practical observations on the implications of the new test for the practice of physicians on the ground.

Highlights include what must a physician now do to satisfy his or her duty to properly advise a patient, is it necessary and sufficient for a physician to follow the SMC guidelines on advice and disclosure and does the new test create uncertainty, and if so, how can physicians manage it?
