Informed Consent for Healthcare Practitioners
A Practical Guide to Informed Consent in the light of Civil Law (amendments) Bill 2020

Informed Consent has changed. Informed Consent is no longer doctor-centric but a more patient-centric approach. Every treatment and procedure come with risks, and the practitioner must inform the patient of these risks to make an informed decision. Inadequate informed Consent becomes a prevalent reason why patients seek legal redress, especially when the outcome is less than desired.

To ensure effective informed consent, the doctors must now ensure that patients are aware of any “material risks” involved in a proposed treatment, and of reasonable alternatives, following the judgment in the case Montgomery v Lanarkshire Health Board, and Dr Lim Lian Arn v Singapore Medical Council (SMC).

The legislative changes to the Singapore Civil Law (Amendment) Bill 2020 and the Medical Registration (Amendment) Bill 2020 were set out to strengthen the medical disciplinary process that is to provide clearer, fairer, timelier and more robust, and bring clarity, certainty and consistency to the standard of care when taking informed consent (Singapore Ministry of Health, Amendments to Medical Registration Act and Civil Law Act, 6 Oct 2020).

Here are some of the common questions or challenges faced by healthcare professionals:

  • What does the law say about informed consent?
  • How do the changes in legislation affect the process and ways of taking informed consent?
  • What do I need to do to stay within the boundaries of safe practice?
  • What happens when the patient complains after a bad outcome and inadequate informed consent is given?
  • How to overcome the challenges when taking informed consent from the special-needs or vulnerable populations?

Developed by senior medical practitioners and faculty from the NUS Yong Loo Lin School of Medicine and the National University Hospital Patient Relations Department, this course provides healthcare professionals with a practical guide to informed consent in Singapore. Through faculty presentations, facilitations, supported by case studies, scenario plays and peer discussions, learners will review details of consent in medical practice.
